Annual inspections for motorcoaches, party buses and church buses

Any bus designed for 16 or more people, including the driver, is a federal commercial motor vehicle in interstate use, and so is a 9 to 15 passenger vehicle carrying people for pay. Each needs an annual inspection. Several states also run their own bus programs, and some require them instead of a private inspection.

When does the federal annual apply to a bus?

When the bus is used in interstate commerce and is designed or used to carry 16 or more people, including the driver, or 9 to 15 people, including the driver, for pay (49 CFR 390.5). Each such bus needs an annual inspection of all Appendix A items, including bus-specific items, with proof on board (49 CFR 396.17).

Which states have their own bus inspection rules?

Many do. Ohio's bus inspection program, run by the State Highway Patrol, is accepted by FMCSA in place of the federal annual (FMCSA notice, 2001). Indiana requires an inspection for private buses with more than 15 passengers, including church buses, at each registration (IC 9-19-22).

Frequently asked questions

If it's designed for 16 or more people and crosses state lines, the federal annual applies. In Indiana, church buses over 15 passengers also need the state private bus inspection.

If it's designed for 16 or more people, or for 9 to 15 people and carries passengers for pay, and it's used across state lines, yes (49 CFR 390.5). Your state may add its own bus rules.

Ohio's State Highway Patrol bus inspection is the FMCSA-accepted program for buses there. If your vehicle is required to go through a state program, a private inspection won't substitute. See Ohio.
