Inspection expired or failed at roadside? Here's what to do now.

If an officer cited you for no proof of annual inspection, the citation is usually under 49 CFR 396.17(c). It goes on your carrier's inspection record and carries a CSA severity weight of 4. Your next move is to get a valid annual inspection done and documented. Book a fast-track inspection and we'll get started.

What does a "no annual inspection" citation mean?

It means the officer couldn't confirm your vehicle passed an annual inspection in the last 12 months, either because it expired or because the proof wasn't on the vehicle. In FMCSA roadside data, this violation was cited 227,662 times in 2025 and was rarely an out-of-service violation on its own (J.J. Keller analysis of FMCSA data).

FineSet by the state where you were stopped. Federal penalties can apply after an audit or investigation.

What should I do in the next 24 hours?

Start with what the officer gave you, fix anything that's out of service, then get inspected. The carrier has 15 days to certify that violations on a roadside inspection report were corrected and return it, so don't let the paperwork sit (49 CFR 396.9).

  1. 01

    Keep the inspection report.

Give it to your carrier (or keep it, if you are the carrier).

  2. 02

    Fix out-of-service defects first.

A vehicle declared out of service can't be operated until repairs are made, except as the officer allows.

  3. 03

    Get a valid annual inspection.

Book a fast-track Bright Inspect inspection, or use your state's program if your vehicle requires one.

  4. 04

    Certify and return the report.

Sign the correction section and return it to the issuing agency within 15 days.

  5. 05

    Set a reminder.

Bright Inspect reminds you 30 days before your next annual is due.

Can Bright Inspect remove the violation?

No. Nobody can promise to remove a violation, clear an out-of-service order or change a safety score. What we can do is get your inspection done fast and give you a complete record. If you believe a violation was recorded in error, FMCSA's DataQs system is where carriers and drivers request a review.

Was it a roadside "Level 1"? Does that count as my annual?

Usually not. Since a 2016 rule change, a roadside inspection is not treated as your annual unless it's done under a state periodic inspection program that meets the federal standard (2016 FMCSA final rule). Even a clean roadside inspection with a CVSA decal doesn't replace the annual.

Roadside questions

If the officer did not place the vehicle out of service, you may be allowed to continue, but the vehicle still lacks a valid annual inspection. Each further trip risks another citation. Get inspected before your next dispatch.

Get a copy of the report from whoever did the inspection. Federal rules let the carrier produce the report on demand of an official (396.21(b)), but proof also has to be on the vehicle. Bright Inspect records live in your account, so they're always on your phone.

A federal annual inspection is valid in every state. Problems come up when your vehicle is registered in a state that requires its own program, such as Pennsylvania. Check your state page.
